Copyright

If something published in the Library is yours and you did not give permission, this is how to claim it.

01What it covers

In the Kapiz Library, users publish algorithms, indicators and strategies that others install. Kapiz does not review each publication before it appears, and whoever publishes declares they have the right to do so.

If you believe a publication copies your work without permission, for example your code or your paid indicator, this page explains how to ask for it to be removed.

02Who to notify

Claims go to our designated agent:

The agent is listed in the U.S. Copyright Office's directory of designated agents under number DMCA-1083633.

This address is only for copyright claims. For anything else, use the contact page.

03How to file a claim

Write to [email protected] with the following. Without this information we cannot act:

  • Your full name, address, phone number and email.
  • The work being infringed: what it is and where the original can be seen.
  • The Library publication that infringes it: its name and the name of whoever published it, so we can find it.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
  • A statement, under penalty of perjury, that the information in the claim is accurate and that you are the copyright owner or authorized to act on its behalf.
  • Your signature, which can be your full name typed at the end of the email.

A false or bad faith claim can make you liable for the damages it causes, including the costs of the publisher and of Kapiz.

04What we do

  • We confirm that we received the claim. If anything is missing, we ask you for it.
  • If it is complete, we promptly remove the publication from the Library or block access to it.
  • We notify whoever published it, with a copy of the claim, and explain how they can respond.

05Counter-notice

If you published something we removed and you believe it was a mistake or that you have the right to publish it, you can reply to [email protected] with:

  • Your full name, address, phone number and email.
  • The publication that was removed and where it was.
  • A statement, under penalty of perjury, that you have a good faith belief that it was removed by mistake or misidentification.
  • A statement that you consent to the jurisdiction of the federal district court for the district where you live or, if you live outside the United States, of any judicial district in which Kapiz may be found, and that you will accept service of process from the person who filed the claim.
  • Your signature, which can be your full name typed at the end of the email.

We send your response to the claimant. If within 10 to 14 business days they do not tell us they have filed an action to restrain the infringement, we republish the content.

06Repeat infringers

We close the account of anyone who accumulates three valid copyright claims, meaning claims not reversed by a counter-notice. In serious cases we may close it sooner.

07In Chile

Under Chile's Intellectual Property Law 17.336 (article 85 L), Kapiz's representative for receiving judicial notices about copyright is:

  • Paulina Elgueta, KAPIZ SpA, Antonio Bellet 193 of 1210, PROVIDENCIA

When a Chilean court orders content to be removed or access to it blocked, we comply without delay. You can also use the procedure on this page even without a court order.
